Constitution
A Constitution sets out the purpose and rules of your Centre. It is the basic document which helps to ensure smooth and proper running of your Centres affairs. Your Centres Constitution will set out:
The objectives for your Centre
The different forms of membership and their subscription rates
The rules by which your Centre will operate.
How the affairs of the Centre are to be managed (e.g. by the Committee and its officers)
How the Committee members control the Centre, through an Annual General Meeting.
Elements in your Centre’s Constitution may need to be amended or deleted as appropriate to your centre. You may also need to reduce or increase the general committee officers, dependant on the number of volunteers available to fill the positions.

Regulations are the key ‘delegated legislation’ of the Centre (sometimes referred to as by-laws).
These are key rule and policy documents, which addresses a whole range of issues for a Centre.

Department of Fair Trading
If a centre or jointly affiliated club makes any changes to their constitution they are required to lodge this with the Department of Fair Trading using the form provided at the link below.

Incorporation
To be or to remain eligible for affiliation with Little Athletics NSW, your centre must be Incorporated or be in the process of becoming an Incorporated Association under the Associations Incorporation Act 2009.
What is Incorporation?
Incorporation is a voluntary, simple and inexpensive means of establishing a legal entity, separate from the individual members. Incorporating separates the individual person (member) from the entity. Incorporation makes the group (body) a single entity with certain rights and legal protections, as well as some additional obligations.
How to Become Incorporated
To become incorporated, your centre must:
Understand your obligations and requirements of Fair Trading NSW.
Your centre must have 5 or more individuals to apply for registration
Develop a Constitution and lodge with Fair Trading NSW (templates can be found on the LANSW website). A constitution sets out the purpose and rules of your centre. Public Officer - Your centre must appoint a public officer who is over 18 years of age and is a resident of New South Wales. The public officer is an authorised signatory for your association and is the official point of contact for Fair Trading NSW.
NSW Fair Trading form must be lodged by the Public Officer of the association within 28 days after taking office as the Public Officer or within 28 days of a change in the official address of the association. Your centre must have an official address within New South Wales.
Your centre will need to lodge your financial summary with Fair Trading NSW, following your AGM (within 1 month) annually to remain incorporated. A12 Form - Annual summary of financial affairs annually to remain incorporated
